In a rather shocking chain of events, a Mercedes car owner demanded Rs 5 lakh from the Ghaziabad Municipal Commissioner after his car got stranded on a flooded road. Many Indian roads, unfortunately, suffer from the issue of waterlogging during the monsoon rains. The water gets accumulated in public places, streets and roads, causing distress to the general public. Hence, we see cars getting stuck, damage to the property and in some cases, loss of lives. Mercedes Owner Sends Legal Notice to Ghaziabad Municipal Commissioner

As per the information available, a Ghaziabad resident, Amit Kishore, sent a legal notice to the MC seeking Rs 5 lakh in compensation for the repair cost of his car due to allegedly getting stranded on flooded streets after the recent heavy rainfall. He claimed that his Mercedes GLA 200D developed a mechanical snag after being in water for around 2 hours in Sahibabad’s Lajpat Nagar. Eventually, the car had to be towed to the service centre, where the estimated for the repair was Rs 5 lakh.
The notice from Kishore’s lawyer read, “Your failure to fulfil your statutory duties under the Municipal Corporation Act, Public Health Acts, and Environmental Protection Laws, as well as your breach of duty of care owed to the residents, makes you liable for financial, physical, and mental damages caused to my client and others similarly affected.” Furthermore, it states that if no action is taken within 15 days, Kishore would initiate legal proceedings.
In response to this, Vikramaditya Malik, Municipal Commissioner, told TOI that the applicant would have to prove that his car broke down due to waterlogging. He said, “If the waterlogging caused his vehicle to break down, why didn’t the same happen to other vehicles parked on the same street? On July 23, there was excessive rainfall, and IMD issued alerts as well. It led to waterlogging across NCR, but there were no other reports of vehicle breakdowns caused solely by it.” It remains to be seen how things pan out going forward.
