Who Should Pay Damage Police Tows Car

It is necessary to know who is liable to pay for the damage if the Police tows away your car. You must have seen cops taking away cars from no-parking zones. It happens in every part of the country. People often park in a crowded space in a local area to maybe purchase some items. However, there are no-parking zones in such places to prevent traffic jams and congestion. That is where the problem arises. As a result, the traffic Police tows away cars to the Police station. But what if they damage your car in the process?

Who Should Pay For Damage If Police Tows Your Car?

This post comes from naitikcarstatus_yt on Instagram. It contains clips of instances where the towing van is taking away the cars but they suffer damage somehow. The reasons could be simple. At times, it is possible that the connection is not secure. The hook might be loose in some cases. This results is the car getting damaged when towed. In fact, on one instance in this video clip, the front bumper and bonnet of a Mercedes are seen getting damaged as the towing hook snaps out of place on a slope. The Merc is seen driving backward uncontrolled. That is a safety hazard for everyone around.

As per the law, it is the responsibility of the Police to ensure that the car is towed away safely. In fact, if the car owner parks in no-parking zone, the Police must first make an announcement using a loud speaker to warn the owner. They must wait for at least 15 mins (time depends on different local rules). If the owner comes, he just has to pay the fine for parking wrongly. However, it he/she doesn’t arrive, the Police can take the car away. During this time, if there is any damage to the car, you can approach the authorities to claim the expenses needed to fix the damage. In some cases, even the insurance company can pay for the damage. In fact, in 2003, the Bombay High Court had ruled that a car owner can claim compensation from the towing operator if his vehicle is damaged during the process.

It becomes critical to understand that the Police can tow away a car after following the proper procedure but they can’t damage your car. That will have consequences if you follow the legal route. Make sure to get the receipt of the towing charges from the Police and the photo of the damage caused to your car. But we hope that you don’t have to go through this process ever.
